Terms of Service

These Terms of Service ("Terms") govern your access to and use of StampScan (the "Service"), operated by Eric Manning ("StampScan", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

StampScan is software that helps sellers create mailing labels carrying USPS Intelligent Mail barcodes and follow those mailpieces using USPS scan data. We are not the United States Postal Service, we are not affiliated with or endorsed by USPS, and we do not carry, handle, or deliver mail.

You must be at least 18 years old and able to form a binding contract. You are responsible for your login credentials and for all activity under your account. Keep your information accurate and current, and notify us promptly of any unauthorized use.

When you import orders or enter recipient details, you provide personal information about your customers. You are the controller of that information, and StampScan processes it on your behalf to provide the Service (see our Privacy Policy). You represent that you have the right to provide it and to have tracking notifications sent to your customers.

6. Tracking accuracy and no guarantee of delivery

Tracking is based on USPS Intelligent Mail (IMb) scan events obtained through USPS Informed Visibility. Letter mail is not always scanned and typically has no final delivery scan, so a "delivered" status is inferred, not confirmed by USPS. Scan timing and availability vary. StampScan does not guarantee that any mailpiece will be scanned, tracked, or delivered, and the Service is not mail insurance.

7. Third-party services

The Service integrates with third parties such as USPS, Stripe, Shopify, Etsy, and eBay. Your use of those services is governed by their own terms, and we are not responsible for them. Their APIs and access may change or be withdrawn.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may modify, suspend, or discontinue features at any time.

9. Intellectual property

The Service, including its software, design, and content (excluding your content), is owned by StampScan and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain rights to the logo, branding, and content you upload, and you grant us a license to host and use it as needed to provide the Service.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, StampScan and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost or delayed mail, refunds you owe your customers, or marketplace penalties, arising out of or related to the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless StampScan from claims, damages, and expenses arising from your use of the Service, your mailpieces, your content, your customers' data, or your violation of these Terms or any law or third-party right.

13. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk or legal exposure. On termination, your right to use the Service ends, and provisions that by their nature should survive will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The state and federal courts located in San Francisco County, California will have exclusive jurisdiction, and you consent to their jurisdiction and venue.

15. Changes to these Terms

We may update these Terms. If we make material changes, we will provide reasonable notice, for example by posting the updated Terms with a new date. Continued use after the changes take effect means you accept them.
